Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website the-trucking-school.com (the "Site") and the services offered by Teresa Transportation LLC, doing business as The Trucking School ("The Trucking School," "we," "us," or "our"). By accessing or using the Site, or by enrolling in or purchasing any of our programs or services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
1. About Our Services
The Trucking School provides commercial driver's license (CDL) training and related educational services from our facility located at 851 W 6400 S, Spanish Fork, UT 84660. Information on the Site describing our programs, schedules, and pricing is provided for general informational purposes and may change at any time without notice.
2. Enrollment Agreement Controls
When you enroll in a training program, you sign a separate Enrollment Agreement that governs the specific terms of your training, including tuition, fees, attendance, refunds, cancellation, and other program obligations. That signed Enrollment Agreement is the binding contract for your program. If anything in these Terms conflicts with your signed Enrollment Agreement, the Enrollment Agreement controls with respect to your training.
3. Eligibility
You must be at least 18 years old to use the Site and to enroll in our programs. By using the Site or enrolling, you represent that you meet this requirement and that the information you provide is accurate and complete.
4. Tuition, Fees, and Payment
- Program tuition and fees are as stated in your Enrollment Agreement at the time of enrollment.
- The registration fee is non-refundable.
- You are responsible for the full amount of tuition and fees you agree to pay, including any amounts financed through a third party.
- The Trucking School does not lend funds to students. If you choose to finance your education through a third-party private lending institution, you alone are responsible for all payments and monies owed, and the third-party lender is responsible for all required lending disclosures.
- Additional charges may apply for services such as retesting or optional additional training, as described in your Enrollment Agreement.
5. Cancellation and Refunds
You have the right to cancel your agreement or withdraw from the program at any time. Refund eligibility and the amount of any refund are governed by the Cancellation and Refund Policy set out in your signed Enrollment Agreement. In summary, and subject to that Agreement:
- You may be eligible for a prorated refund based on the training hours completed if you have not completed more than 50% of the training.
- The registration fee is non-refundable.
- You are responsible for charges related to third-party services such as DOT drug testing, DOT physicals, and background checks.
- Reschedule and course-credit terms apply if you are unable to attend your scheduled start date, as described in the Enrollment Agreement.
The Enrollment Agreement is the definitive statement of your cancellation and refund rights.
6. Placement Assistance Disclaimer
The Trucking School may provide job placement assistance to students and graduates. However, we do not and cannot promise or guarantee employment, or any particular level of income or wage rate, to any student or graduate. Any statements about employment prospects are for informational purposes only and are not a guarantee.
7. Transferability of Credits and Credentials
The transferability of any credits or credentials you earn at The Trucking School is at the complete discretion of any institution to which you may seek to transfer. Acceptance of the certificate you earn is also at the discretion of that institution. If a certificate you earn is not accepted, you may be required to repeat some or all coursework. You should confirm in advance whether your training will meet your educational and transfer goals.
8. Acceptable Use of the Site
When using the Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms;
- Attempt to gain unauthorized access to the Site, our systems, or other users' information;
- Interfere with or disrupt the operation or security of the Site;
- Copy, reproduce, or distribute Site content without our permission; or
- Submit false, misleading, or fraudulent information.
9. Intellectual Property
All content on the Site, including text, graphics, logos, course descriptions, and materials, is the property of The Trucking School or its licensors and is protected by applicable intellectual property laws. You may not use our content or trademarks without our prior written consent.
10. Third-Party Links and Services
The Site may contain links to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any third-party sites. Your use of third-party services is at your own risk and subject to their terms.
11. Disclaimers
The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
12. Limitation of Liability
To the fullest extent permitted by law, The Trucking School and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or our services. Nothing in these Terms limits any rights you have under your signed Enrollment Agreement or under applicable law.
13. Indemnification
You agree to indemnify and hold harmless The Trucking School and its owners, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Utah. Disputes relating specifically to your training program are governed by the terms of your signed Enrollment Agreement.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
